Renting a pending foreclosure

If you have entered into lease before the date to the “notice of foreclosure” you may have certain protections. “The date on which complete title to a property is transferred to a successor entity or person as a result of an order of a court or pursuant to provisions in a mortgage, deed of trust or security deed.” Tenants with a bonafide lease can remain in a foreclosed home according to the terms of their lease until the immediate successor in interest (often the bank) sells the property to a buyer who intends to occupy the home. The tenants must receive 90 days’ notice to vacate.
